FCC 10-88 - (First notice) In this document, the Commission adopts an interim rule addressing the certification of provider information for Telecommunications Relay Services (TRS) calls. By requiring providers to be more accountable for their submissions, the Commission takes necessary, affirmative steps to preserve the Interstate TRS Fund (Fund).
DATES: Effective July 13, 2010, except for the amendment to 47 CFR 64.604 (c)(5)(iii)(I), which contains new information collection requirements subject to the Paperwork Reduction Act (PRA) that have not been approved by the Office of Management and Budget (OMB). The Commission will publish a document in the Federal Register announcing the effective date of these requirements.
FCC 10-88 - (Second Notice) In this document, the Commission reiterates that Interstate Telecommunications Relay Service (TRS) Fund (Fund) payments may be suspended to providers that do not submit to audits. The Commission is authorized to do so pursuant to its rules intended to protect the integrity of the Fund and to deter and detect waste, fraud, and abuse. The Commission and the Fund administrator have conducted some audits, but not all providers have submitted to the auditing process.

DA 08-2808 - In this document, the Consumer and Governmental Affairs Bureau (Bureau) extends for an additional year waivers of certain Telecommunications Relay Services (TRS) mandatory minimum standards for Video Relay Service (VRS) and Internet Protocol Relay (IP Relay). The waived TRS mandatory minimum standards are: One-line voice carry over (VCO); VCO-to-teletypewriter (TTY); VCO-to-VCO; one-line hearing carry over (HCO); HCO-to-TTY; HCO-to-HCO; call release; pay-per-call (900) calls; types of calls; equal access to interexchange carriers; and speech-to-speech (STS). Also, in this document, the Bureau grants a limited extension of the waiver of the speed dialing requirement for IP Relay. The Bureau extends the waivers for one year (four months in the case of speed dialing for IP Relay) because the record demonstrates that it is technologically infeasible for VRS and IP Relay providers to offer these services at this time.
DATES: The waivers of certain TRS mandatory minimum standards for VRS and IP Relay will expire on January 1, 2010, except the limited extension of the wavier of the speed dialing requirement for IP Relay, which expired on May 1, 2009.
DA 09-1436 - In 8/07/09 Federal Register. In this document, the FCC, via the Consumer and Governmental Affairs Bureau, seeks to refresh the record on a petition filed by various consumer groups requesting that the FCC initiate a rulemaking to make Captioned Telephone Relay Service a mandatory form of telecommunications relay service (TRS). This issue has been raised again in a recently filed supplement to the petition, and comment is sought on the supplement as well.

DA 09-40 - In 8/07/09 Federal Register. This document amends the FCC’s rules so that providers of interconnected VoIP service will be required to comply with the same discontinuance rules as domestic non-dominant telecommunications carriers. These rules protect consumers of interconnected VoIP service from the abrupt discontinuance, reduction or impairment of their service by requiring:prior notice to customers and the filing of an application with the Commission.
DATES: Effective September 8, 2009 except for §§ 63.60(a) and (f) which affect information collection requirements that are not effective until approved by the Office of Management and Budget. The FCC will publish a document in the Federal Register announcing the effective date for those sections.

DATES: Effective June 26, 2009. Traditional TRS providers are granted a waiver until June 29, 2010.
DA 09-1318 - In 06/19/09 Federal Register, In this document, the FCC reminds telecommunications relay services (TRS) providers and state TRS administrators that they must submit their annual consumer complaint log summaries. In addition, the FCC reminds TRS providers and state administrators of their ongoing obligations to submit to the FCC a contact person or office for TRS consumer information and complaints and to notify the Commission of any substantive changes to their TRS programs.

DA 09 -1255 - In 6/16/09 Federal Register, In this document, the FCC extends the comment filing deadline for the Notice of Proposed Rulemaking (NPRM) published in the Federal Register May 21, 2009 (73 FR 23815). The Bureau finds that in this case an extension of the comment period is warranted to afford parties the necessary time to file comments that will result in a more complete record in this proceeding. DA 09-211 - In June 12, 2009 Federal Register, In this document, the FCC states that current rules require that TRS providers submitting minutes for payment from the Interstate TRS Fund must measure the conversation time of each call to the nearest second, and when the time for such calls is expressed in decimal form, the TRS provider must round the time to the nearest tenth of a minute.

DA 08-821 - In May 15, 2008 Federal Register - In this document, the Consumer and Governmental Affairs Bureau (Bureau) grants interconnected voice over Internet Protocol (VoIP) providers an extension of time to route 711-dialed calls to an appropriate telecommunications relay service (TRS) center in the context of 711-dialed calls in which the calling party's telephone number may not reflect his or her geographic location. The Bureau also grants traditional TRS providers (those providing relay service via the public switched telephone network (PSTN) and a text telephone (TTY)) an extension of time to fulfill their obligation to implement a system to automatically and immediately call an appropriate Public Safety Answering Point (PSAP) when receiving an emergency 711- dialed call via an interconnected VoIP service. The Bureau takes this action based on information in the record reflecting the significant technical challenges presented by this requirement and on the Bureau's finding that the delivery of the inbound leg of a 711-dialed call by an interconnected VoIP provider to the appropriate relay center is a predicate to the delivery by the relay center of the outbound leg of such a call to an appropriate PSAP.
DATES: Document DA 08 - 821 became effective on April 4, 2008. Interconnected VoIP providers are granted a waiver, until March 31, 2009, of the requirement to route 711-dialed calls to an appropriate relay center, but only in the context of 711-dialed calls in which the calling party is using a non-geographically relevant telephone number or a nomadic interconnected VoIP service. Traditional TRS Providers are granted an extension of time, until March 31, 2009, to implement a system to automatically and immediately call an appropriate PSAP when receiving an emergency 711-dialed call via an interconnected VoIP service.

DA 08-478 - In April 30, 2008 Federal Register - SUMMARY: The FCC clarifies the eligibility requirement for compensation from the TRS Fund for providers of Internet Protocol (IP) captioned telephone service (IP CTS). The Bureau also clarifies that an IP CTS provider seeking compensation from the Fund must notify the Interstate TRS Fund administrator 30 days prior to the date the provider submits minutes for payment.
DA 08-312 - In 4-23-08 Federal Register - The FCC grants a request to stay the effectiveness of paragraphs 95 and 96 of the 2007 TRS Cost Recovery Declaratory Ruling, which restrict TRS providers from using consumer or call databases to contact TRS users. Because these paragraphs have been challenged in the Court of Appeals, a stay is appropriate pending review of the argument that these paragraphs violate the First Amendment rights of providers.DATES: Paragraphs 95 and 96 of the 2007 TRS Cost Recovery Declaratory Ruling, as summarized in paragraph 24, published at 73 FR 3197, January 17, 2008, are stayed for 90 days, starting February 7, 2008.

FCC 08-275 - In December 30, 2008 Federal Register - The FCC addressed several issues relating to the FCC's Internet-based TRS Order, which adopted a system to assign users of Internet-based TRS, specifically VRS and IP Relay, ten-digit numbers linked to the North American Numbering Plan.DATES: Effective December 31, 2008, except for the information collection requirements contained in § 64.605 that are not effective until approved by the Office of Management and Budget (OMB). The FCC will publish a document in the Federal Register announcing the effective date for the information collections in this section.
FCC 08-210 - In October 23, 2008 Federal Register. In this document, the FCC grants a petition for limited waiver filed by Sorenson Communications, Inc. The waiver allows Sorenson, and all other VRS providers, prior to the implementation of new emergency call handling rules, to deliver to the appropriate emergency response authorities, at the outset of the outbound leg of an emergency VRS call, the caller's North American Numbering Plan callback number, when known to the provider, rather than the callback number of the CA. TheFCC also reiterates its requirement that VRS providers implement a system to ensure that all incoming emergency calls (including callbacks from emergency personnel) are answered by the provider before non-emergency calls. This Commercial Mobile Alert System Third R&O (CMAS Third R&O) representsthe next step in establishing a Commercial Mobile Alert System (CMAS), under which CMS providers may elect to transmit emergency alerts to the public.It takes this step pursuant to the mandate of section 602(b) of the WARN Act, which requires the Commission to adopt rules allowing any CMS provider to transmit emergency alerts to its subscribers; requires CMS providers that elect, in whole or in part, not to transmit emergency alerts to provide clear and conspicuous notice at the point of sale of any CMS devices that they will not transmit such alerts via that device; and requires CMS providers that elect not to transmit emergency alerts to notify their existing subscribers of their election.

FCC 08-151 (Final Rule) In July 18, 2008 Federal Register - In this document, theFCC adopts a system for assigning users of Internet-based TRS, specifically VRS and IP Relay, ten-digit telephone numbers linked to the North American Numbering Plan (NANP). This numbering system will further the TRS functional equivalency mandate by ensuring that Internet-based TRS users can be reached by voice telephone users in the same way that voice telephone users are called. The measures theFCC adopts also are intended to ensure that emergency calls placed by Internet-based TRS users will be routed directly and automatically to the appropriate emergency services authorities by Internet-based TRS providers.

FCC 08-68 and FCC 08-117 - In May 7, 2008 Federal Register - The FCCadopts various proposals to amend its hearing aid compatibility policies and requirements pertaining to wireless services, including modifications and other requirements along the framework proposed in a consensus plan (Joint Consensus Plan) developed jointly by industry and representatives for the deaf and hard of hearing community. The Commission anticipates that these rule changes, taken together and largely supported by manufacturers, service providers, and consumers with hearing loss, will meet statutory obligations to ensure reasonable access to telephone service by persons with impaired hearing. These requirements are intended to benefit wireless users in the deaf and hard of hearing community, including the most disadvantaged who are more likely to rely on telecoilequipped hearing aids, as well as to ensure that these consumers have a variety of handsets available to them, including handsets with innovative features.

In this document, theFCC announces that the Office of Management and Budget has approved, for a period of three years, the information collection associated with the FCC's Telecommunications Relay Services and Speech-to-Speech Services for Individuals with Hearing and Speech Disabilities, Report and Order and Declaratory Ruling (2007 TRS Cost Recovery Order). This notice is consistent with the 2007 TRS Cost Recovery Order, which stated that the Commission would publish a document in the Federal Register announcing the effective date of the rule.
DATES: Section 64.604(c)(5)(iii)(C), published at 73 FR 3197, January 17, 2008, is effective July 30, 2008.
FCC 07-110 - In 4-21-08 Federal Register - ACTION: Final rule.SUMMARY: The FCC amends it rules to remove notes contained in the Access to Telecommunications Service, Telecommunications Equipment and Customer Premises Equipment by Persons with Disabilities rules, and the Miscellaneous Rules Relating to Common Carriers. The notes indicated that the Commission would publish notice of the effective date of the rules after it obtained OMB approval.
