 FCC News Release - March 9, 2010 - PURPLE COMMUNICATIONS ACKNOWLEDGES DEBT, BEGINS PAYBACK TO TELECOMMUNICATIONS RELAY FUND

Washington, DC -- Purple Communications, a provider of telecommunications relay services, has signed an agreement with the FCC that puts in place the framework for repayment of funds that were inappropriately paid to the company. Under this agreement, Purple “acknowledges that the FCC [has stated that Purple has] a debt amounting to $18,459,064, and has determined not to challenge the FCC’s position.” Under the agreement, the funds will be repaid to the National Exchange Carriers Association (NECA), which administers the government fund that pays for relay services for deaf and hard-of-hearing consumers. In return for this commitment, the FCC will instruct NECA to release payment to Purple for relay services provided in the month of December 2009, and will continue to reimburse for legitimate relay services provided by Purple month by month.

DA 10-93 - The Enforcement Bureau has taken action against several companies for their failure to provide information that helps individuals with hearing disabilities fully utilize wireless phone services – allowing them to communicate effectively on
their wireless phones without excessive feedback and noise.

DA 09-2556 - FCC’s PUBLIC SAFETY AND HOMELAND SECURITY BUREAU SETS TIMETABLE IN MOTION FOR COMMERCIAL MOBILE SERVICE PROVIDERS TO DEVELOP A SYSTEM THAT WILL DELIVER ALERTS TO MOBILE DEVICES, PS Docket No. 07-287

Washington D.C. – The Public Safety and Homeland Security Bureau (PSHSB) of the Federal Communications Commission today initiated the 28-month period during which participating Commercial Mobile Service (CMS) providers must develop, test and deploy the Commercial Mobile Alert System (CMAS). This period was established by the Commission in 2008 and developed pursuant to the WARN Act. The CMAS is a voluntary service through which CMS providers that elect to do so may deliver timely and accurate emergency alerts and warnings to the public over cell phones and other mobile devices. PSHSB is taking this action as required by section 10.11 of the Commission’s rules, which states that participating CMS providers must begin to develop and test the CMAS no later than 10 months from the date that the Federal Emergency Management Agency (FEMA) makes available design specifications for the Government Interface that will allow FEMA to deliver alerts to participating CMS providers. The end of that development and testing period will trigger an implementation and deployment period, not exceeding 18 months, culminating in the availability of the CMAS to the public.

 


 FCC News Release - FCC ANNOUNCES WORKSHOP ON VRS REFORM TO BE HELD ON DECEMBER 17, 2009;  The Federal Communications Commission today announces it will hold a workshop on December 17, 2009, as part of its comprehensive review of the Video Relay Service (VRS) program, to ensure that the program’s underlying structure fosters the efficient, effective, and lawful provision of VRS. This workshop is open to the public and is intended to gather data and information on these key areas:

1) The most efficient way to deliver VRS, particularly whether the service should remain a competitive service or be provided via competitive bidding;

2) A fair, efficient, and transparent compensation methodology; and,

3) Mechanisms for combating waste, fraud and abuse, addressing service rules, and addressing technical matters such as interoperability, ten-digit numbering, and emergency call handling. The Commission will provide additional details about the workshop as it approaches.

FCC News Release - FCC CHIEF OF STAFF PRAISES DECISIVE ACTION TO PROSECUTE FRAUD IN VRS PROGRAM - Twenty-six people were charged today with engaging in a scheme to steal more than $50 million from the Video Relay Service (VRS) program. VRS is an online translation service that allows people with hearing disabilities to communicate through the use of interpreters and Web cameras, at no cost to the user. The VRS program reimburses companies that provide this service, and is funded by fees assessed by telecommunications providers to telephone customers. The arrests were announced by Assistant Attorney General Lanny A. Breuer of the Department of Justice’s Criminal Division, Assistant Director of the FBI’s Washington Field Office Joseph Persichini, Jr., Deputy Chief Postal Inspector Zane Hill, and FCC Chief of Staff Edward Lazarus, at a press conference Thursday.

 DA 09-29443A1, FCC ANNOUNCES PARTICIPANTS FOR NOV. 6 FIELD HEARING ON BROADBAND ACCESS FOR PEOPLE WITH DISABILITIES

Hearing Location at Gallaudet University Changed to Kellogg Conference Center

Two distinguished panels of experts will participate in the Federal Communications Commission’s Nov. 6 hearing at Gallaudet University on broadband access for people with disabilities. The two panels will discuss broadband experiences, barriers, opportunities and solutions for people with disabilities. Commissioner Michael Copps will host the hearing.

Among those on the first panel will be Academy Award-winning actress Marlee Matlin, who is the National Association of the Deaf’s spokesperson for accessible broadband services and Internet media. Matlin won the Academy Award for her role in the movie “Children of a Lesser God,” in which she played a deaf woman working at a school for the deaf and hard of hearing in New England.

FCC ANNOUNCES FIELD HEARING ON BROADBAND ACCESS FOR PEOPLE WITH DISABILITIES -Commissioner Copps to Host Hearing at Gallaudet University

The Federal Communications Commission has scheduled a field hearing at Gallaudet University in Washington, D.C. on November 6, 2009 on disabilities access issues as part of its effort to gather information from experts and consumers for the development of a National Broadband Plan. DA 09-2097 - On June 26, 2009, Qwest Wireless filed a petition for waiver of the Interstate Telecommunications Relay Service (TRS) Fund contribution requirement contained in the Commission’s rules, 47 C.F.R. §64.604(c)(5)(iii). Specifically, Qwest Wireless seeks a waiver of the relevant contribution rule so that it would not contribute to the Interstate TRS Fund in the funding year beginning July 1, 2009. Qwest Wireless states that it is exiting the telecommunications business and will discontinue service on October 31, 2009. Qwest Wireless further states that it is seeking this waiver “so that its contributions to the TRS Fund in calendar year 2009 are better aligned with the recovery of TRS costs from its current customers.

FCC Public Notice -9-8-09, REPORT ON INFORMAL CONSUMER COMPLAINTS REGARDING ACCESS TO TELECOMMUNICATIONS FOR PEOPLE WITH DISABILITIES

The Consumer & Governmental Affairs Bureau (CGB) announces information regarding informal consumer complaints processed by the Disability Rights Office (DRO) during the first quarter of the calendar year 2009. DRO processes informal complaints in the following five categories: (1) access to telecommunications services and equipment (Section 255) (47 U.S.C § 255), (2) telecommunications relay services (TRS) (47 U.S.C § 225), (3) closed captioning (47 C.F.R. § 79.1), (4) accessibility of video programming providing emergency information (47 C.F.R. § 79.2), (5) and hearing aid compatibility (47 U.S.C. § 610).

For the first quarter of 2009 (January 01, 2009 through March 31, 2009), DRO received the following number of informal complaints, by subject matter, implicating the Commission’s disability access rules: 22 informal complaints raised Section 255 issues; 60 informal complaints raised TRS issues; 142 informal complaints raised closed captioning issues; 2 informal complaints raised accessibility of video programming providing emergency information issues; and no informal complaints (zero) raised hearing aid compatibility issues.

 


DA 09-2014 - Released September 3, 2009.  REMINDER REGARDING VIDEO PROGRAMMING DISTRIBUTORS’ OBLIGATION TO MAKE EMERGENCY INFORMATION ACCESSIBLE TO PERSONS WITH HEARING OR VISION DISABILITIES

In light of the present hurricane season, as well as the Southern California wildfires, the Commission issues this Public Notice to remind video programming distributors – including broadcasters, cable operators, satellite television services, and “any other distributor of video programming for residential reception that delivers such programming directly to the home” – of their obligation to make emergency information accessible to persons with hearing and vision disabilities in accordance with section 79.2 of the Commission’s rules. Under section 79.2, emergency information encompasses “critical details” regarding the emergency and how to respond to the emergency. This Public Notice also provides information for consumers regarding the process for filing complaints alleging violations of this requirement.

DA 09-1789 - Released August 11, 2009. On April 13, 2009, Sorenson Communications, Inc. (Sorenson) filed a petition for declaratory ruling or limited waiver regarding the Federal Communications Commission’s (Commission’s) rule that every default provider of Internet-Protocol (IP) Relay service and video relay service (VRS) provide its users a geographically appropriate North American Numbering Plan (NANP) telephone number. Sorenson claims its numbering partner is unable to obtain telephone numbers in every rate center and therefore, Sorenson is unable to provide its users that live in those unserved rate centers a geographically appropriate number. Sorenson further argues that it is not “economically or operationally feasible” for itself or any other IP Relay or VRS provider to obtain telephone numbers in every rate center.

DA 09-1787 - Released August 11, 2009.  In this Public Notice, the FCC clarifies the use of toll free numbers for Internet-based TRS under the Second Internet-based TRS Order. In the Second Internet-based TRS Order, the FCC concluded that “Internet-based TRS users should transition away from the exclusive use of toll free numbers” and required all Internet-based TRS users to obtain “ten-digit geographically appropriate numbers, in accordance with our numbering system.” They further concluded that after June 30, 2009, now extended to November 12, 2009, an “Internet-based TRS user may retain a current toll free number or obtain a new toll free number so long as that toll free number is directed to the ten-digit, geographically appropriate number.” They now clarify that the requirement that an Internet-based TRS user’s “toll free number be directed to the ten-digit, geographically appropriate number” means that a user’s toll free number must be directed to the user’s ten-digit geographic number in the Service Management System (SMS)/800 database, and not in the Internet-based TRS numbering directory. Thus, as of November 12, 2009, any toll free number retained or acquired by Internet-based TRS users must be directed to their ten-digit geographic number in the SMS/800 database.

 


DA 09-1436 - Released June 26, 2009, The FCC seeks to refresh the record on a Petition for Rulemaking (Petition) filed by various consumer groups in 2005 requesting that the Commission initiate a rulemaking to make Captioned Telephone Relay Service (CTS) a mandatory form of telecommunications relay service (TRS). On June 10, 2009, some of the parties to the original Petition filed a supplement reiterating their request for rulemaking to make CTS a mandatory service. DA 09-1318 - Released: June 12, 2009, The Federal Communications Commission’s Consumer & Governmental Affairs Bureau reminds states and interstate telecommunications relay services (TRS) providers that they must submit their annual consumer complaint log summaries for the 12-month period ending May 31, 2009, on or before Wednesday, July 1, 2009.


DA 09-1287 - By this Public Notice, the Commission appoints the National Consumers League, represented by Ms. Debra R. Berlyn, to its twenty-eight member Consumer Advisory Committee. Of this number, twelve (12) members represent interests of consumers, minorities, and low income communities; five (5) members represent disabilities communities; six (6) members represent the interest of Tribal, state and local governments, and, five (5) members are industry representatives. The Committee’s slate is designed to be representative of the Commission’s many constituencies, and the diversity selected will provide a balanced point of view as required by the Federal Advisory Committee Act. This appointment is effective immediately and shall terminate November 17, 2010, or when the Committee is terminated, whichever is earlier.

Rulemaking Public Notice, 4/27/09 - FCC is accepting comments on a petition for rulemaking filed by CSDVRS, Snap Telecommunications, Sprint Nextel, and Viable, Inc. The petition asks the FCC to eliminate its mandate that video relay service providers enable the porting of video customer premises equipment from one default provider to another. Oppositions due May 15.


DA 09-870 - PLEADING CYCLE ESTABLISHED FOR FILING OF OPPPOSITIONS TO PETITION FOR PARTIAL RECONSIDERATION AND LIMITED WAIVER, AND PETITION FOR PARTIAL RECONSIDERATION, CONCERNING THE ASSIGNMENT OF TEN-DIGIT TELEPHONE NUMBERS AND E911 REQUIREMENTS FORINTERNET- BASED TELECOMMUNICATIONS RELAY SERVICE (TRS)

On January 29, 2009, Telecommunications for the Deaf and Hard of Hearing, Inc. and five consumer organizations (TDI Coalition), and GoAmerica, Inc. (GoAmerica), each filed a petition for partial reconsideration of the Commission's Second Internet-based TRS Order. In that order, the Commission concluded, in part, that "only individuals with a hearing or speech disability will be eligible to obtain ten-digit telephone numbers under the numbering system adopted in the Internet-based TRS Order." To this end, the Commission also required providers to verify that persons receiving ten-digit numbers "have a medically recognized hearing or speech disability necessitating their use of TRS" through a self-certification process. FCC 09-31 - 04-08-09, This Notice of Inquiry seeks comment to inform the development of a national broadband plan for our country. Its focus is to enable the build-out and utilization of high-speed broadband infrastructure. But "infrastructure" barely hints at the importance of what we are undertaking. DA 09-675 - 03/25/09, On January 23, 2009, GoAmerica, Inc. filed a petition for rulemaking to amend Section 64.606(a)(2) of theFCC's rules pertaining to the certification of IP TRS providers. GoAmerica requests theFCC amend its rules (1) to prohibit the practice of providing "white label" services by uncertified entities receiving compensation from the Interstate TRS Fund through certified providers, and (2) to require applicants for Internet-based TRS certification to demonstrate sufficient resources and capabilities to provide an Internet-based TRS service. GoAmerica contends that amending the rule is necessary to preserve the integrity of the TRS program and to maintain the quality of Internet-based TRS service. RULEMAKING NO. DA 09-12 - 01-07-09, On February 28, 2008, American Network filed an application for certification as a provider of IP Relay and VRS eligible for compensation from the Interstate TRS Fundpursuant to the provider certification rules. On May 23, 2008, American Network submitted an amendment to its application to also seek certification as a provider of IP CTS. American Network's application is granted, subject to the conditions noted below...


DA 08-2567 - 11-25-08, On June 24, 2008, theFCC released a Report and Order and Further Notice of Proposed Rulemaking in CG Docket No. 03-123 and WC Docket No. 05-196 (Internet-based TRS Order) in which theFCC adopted a system to assign users of IP TRS, specifically VRS, and IP Relay, ten-digit numbers linked to the North American Numbering Plan.
The FCC stated that certain rules adopted in the Internet-based TRS Order, subject to Office of Management and Budget (OMB) approval for new information collection requirements, shall become effective after theFCC publishes a notice in the Federal Register announcing such approval and the relevant effective date. A summary of the Internet-based TRS Order was published in the Federal Register on July 18, 2008. OMB approved the information collections on November 14, 2008. Accordingly, the effective date of the rules adopted in the Internet-based TRS Order, subject to OMB approval for new information collection requirements, is November 24, 2008.

DA 08-2255 - 10/08/08, PLEADING CYCLE ESTABLISHED FOR COMMENTS ON PETITION OF SORENSON COMMUNICATIONS, INC. FOR LIMITED WAIVER - On September 30, 2008, Sorenson filed a petition for limited waiver of theFCC's prohibition on the use of "proxy" and "alias" numbers set forth in the June 24, 2008 Internet-based TRS Order. Sorenson argues that the limited waiver of the Commission's prohibition is necessary to minimize any disruption to users of VRS as they transition to ten-digit, North American Number Plan (NANP) telephone numbers. Specifically, Sorenson seeks to allow its users to continue to receive calls dialed using proxy or alias numbers for a period of one year after the user has received a ten-digit, NANP telephone number. DA 08-2130 - 9/22/08, In this Public Notice,the FCC modifies the filing timeframes in which VRS and IP Relay providers requesting compensation from the Interstate TRS Fund must submit their initial filing for costs associated with implementing the requirements of the June 24, 2008, Numbering Order. Specifically, VRS and IP Relay providers must submit their initial filings by January 30, 2009, for the period of June 24, 2008 through December 31, 2008. Further, VRS and IP Relay providers subsequently must submit costs 30 days after the end of each calendar quarter, as set forth in more detail below, for costs incurred during the preceding quarter.


DA 08-1788 - 07/29/2008. Fcc releases request for quotation for contractor to build and operate centralized database for internet based TRS numbering system. On June 24, 2008, theFCC released a Report and Order adopting a system for assigning North American Number Plan (NANP) ten-digit telephone numbers to Internet-based TRS users. In this Order, theFCC determined that a neutral third-party administrator will build, maintain, and operate a centralized numbering directory mechanism to map the NANP telephone numbers assigned to Internet-based TRS users to an appropriate Internet address (or other appropriate endpoint identifier).  


 

DA 08-1673 - 07/17/2008. Notice is hereby given that the applications for certification of TRS programs of the states listed in this Order have been granted, pursuant to Title IV of the Americans with Disabilities Act (ADA), 47 U.S.C. § 225(f)(2), and section 64.606(b) of the Commission's rules.
 


DA 08-1589 - 07/03/2008. The FCC has received requests for guidance concerning the transferability of Commission certification of Internet-based TRS providers as eligible for compensation from the Interstate TRS Fund (Fund), pursuant to the provider certification rules contained in section 64.605 of the Commission's rules. We clarify that such certification is not transferable. Therefore, in the event that an entity not certified pursuant to section 64.605 purchases, acquires, or merges with another TRS provider, the acquiring or surviving provider must be certified under section 64.605 (or otherwise eligible for compensation from the Fund) before it can receive payments from the Fund. On the other hand, if an entity that is certified pursuant to section 64.605 purchases, acquires, or merges with another TRS provider, the acquiring or surviving provider need only notify the Commission of the change in its TRS program and provision of service within 60 days pursuant to section 64.605(f)(2).
 


DA 08-1483 - 6/25/2008. On June 24, 2008, theFCC released a Report and Order adopting a system for assigning ten-digit telephone numbers to IP TRS users. In this Order, the FCC determined that a centralized numbering directory mechanism will be employed to map the NANP telephone numbers assigned to IP TRS users to an appropriate Internet address (or other appropriate endpoint identifier). TheFCC further determined that a neutral third-party administrator will build, maintain, and operate the central database. As set forth in the Order, the neutral database administrator must be selected, and must construct the database, work with industry to populate the database, test the functionality of the database, and be prepared to support ten-digit numbers for Internet-based TRS users no later than December 31, 2008.

The Consumer & Governmental Affairs Bureau reminds public mobile service providers and digital wireless handset manufacturers of their obligation, effective June 6, 2008, to designate an agent for service of informal complaints received by the Federal Communications Commission ("Commission"), as well as notices, inquiries, and orders relating to hearing aid compatibility.
 


DA 08-1320 - 06/04/2008. Announcement of next meeting date and agenda of consumer advisory committee. "The Committee will also consider recommendations regarding broadband/universal service, relay services and the provision of auditory access to televised programming containing emergency information."
 


DA 08-1087 - 5-7-08. The FCC seeks comment on seven petitions for reconsideration of the Commission's recent Memorandum Opinion and Order addressing requests to extend the September 18, 2006 deadline to provide handsets that meet the Commission's hearing aid compatibility standard for inductive coupling. Each of these petitions seeks reconsideration of that portion of the Memorandum Opinion and Order in which the Commission denied the particular petitioner's request for extension of the deadline. Specifically, the following reconsideration petitions were filed: (1) a joint petition from CTC Telecom, Inc., Blanca Telephone Company, and Farmers Cellular Telephone, Inc., submitted on March 27, 2008; (2) a petition from Iowa Wireless Services, LLC dba iwireless, on behalf of itself and 37 related licensees, submitted on March 27, 2008; (3) a petition from IT&E Overseas, Inc., submitted on March 28, 2008; (4) a petition from North Dakota Network Co., submitted on March 27, 2008; (5) a joint petition from SLO Cellular, Inc. dba Cellular One of San Luis Obispo, and Entertainment Unlimited, submitted on March 28, 2008; (6) a petition from South Slope Cooperative Telephone Co., Inc. dba South Slope Wireless, submitted on March 27, 2008; and (7) a petition from Uintah Basin Electronic Telecommunications dba UBET Wireless, submitted on March 28, 2008. The Wireless Telecommunications Bureau invites the public to comment on these petitions for reconsideration. Interested parties may file comments no later than May 22, 2008. Reply comments are due June 2, 2008. All filings should refer to WT Docket No. 01-309.
 


DA 08-1055 - 05/02/2008. NECA proposes per minute compensation rates based on the 2007 TRS Rate Methodology Order. These calculations result in the following proposed rates: $1.5938 for interstate traditional TRS; $2.7248 for interstate STS; $1.6569 for interstate CTS and interstate and intrastate IP CTS; $1.2865 for interstate and intrastate IP Relay;6 and tiered rates of $6.7362 for the first 50,000 monthly minutes, $6.4675 for monthly minutes between 50,001 and 500,000, and $6.2685 for minutes above 500,000 for interstate and intrastate VRS.
